A&AP Service Terms
Version dated October 13, 2026. Accepted by tapping READY on an order's form. No signature page.
The arrangement is simple: you keep the client, the assignment, the appraisal decisions, and the signature. I complete only the desk work we agree to and return an unsigned draft for your review. I personally review every report before it comes back to you.
In these terms, "I" and "Appraisal Partners" mean Appraisal Partners of Texas, Inc., acting through Matthew Roth. A&AP is the name this work goes out under. These terms cover the two reviewed lanes: partial desk, where you supply the comparables and data, and full desk, where I pull them. The self-service lane runs under the separate A&AP Software Terms.
Agree by tapping READY
Every order has its own form. Under its READY button the form says:
By tapping READY you agree to the A&AP Service Terms for this order.
That tap is the entire agreement step for the order. There is no terms email, PDF, or signing service. If you accepted an earlier version by email, that acceptance still governs work already underway; from here, each order's READY tap accepts the version linked from that form.
For each order:
- Send me the client's order, or let the report file land in your shared folder: the engagement letter, the order, the contract if there is one, and anything the client provided.
- I confirm the order with the lane's rate and the return time, and send the order's form link. The same form goes into the report's Workfile.
- After the inspection, add the photos, sketch, notes, and other agreed materials to the folder, and answer what the form asks.
- Tap READY. That accepts these terms and the quoted rate for this order, and nothing starts without it.
- The finished unsigned report lands in the same folder for your review. Anything the build could not settle comes back on the form as a question.
1. The work
Each order states the desk work I will perform. When that work is significant real property appraisal assistance, I work as an independent subcontractor under the signing appraiser's direction, where permitted.
I do not take the assignment from your client, inspect the property, sign the report, or deliver it to the client. The signing appraiser inspects, independently reviews the draft, makes the final appraisal decisions, signs, and delivers it.
2. Files, tools, and disclosure
By tapping READY on an order, or adding files to its folder, you confirm three things for that order: your client's terms allow this outside help and the file sharing it takes; the property and its market are within your competence; and I am qualified for the agreed assistance.
I use software automation and AI-assisted tools. Here is the setup, which is the disclosure these terms promise before your first order:
- Where the files live. Your order folder is in Google Drive under our Google Workspace business account. The report itself is a TOTAL file from a la mode, the software your report already runs in.
- Who processes them. The order's documents go to the AI model providers we use to build the draft. We may add or change providers as the tools improve. Each runs on a paid account under the provider's standard commercial terms, not a negotiated data agreement.
- Data use. We only use providers that let us keep our sessions out of model training, and we keep that setting off. Nothing from your order is used to train a model, build a product, or serve another customer. Access is per order, and only the order's documents are processed. We never ask for or keep borrower personal information beyond the report's own fields.
- Changes. I tell you in writing before materially changing this setup.
I personally review the draft against the available sources. When disclosure is required, the report accurately identifies my assistance and states that I did not inspect.
I use assignment information only to review your request, perform accepted work, and keep required records. I protect it with reasonable safeguards and do not sell it, solicit your client, or share it without permission. I report any known unauthorized access affecting your information to you the same day. You own the report and delivered files. Appraisal Partners keeps a confidential workfile of its assistance for five years, or longer if required, and gives you a copy on request. Our nonpublic tools and process remain ours.
3. Price, changes, and revisions
The rate quoted for the order does not change. If materially different work appears, I pause that added work and quote it before proceeding. Delivered work is invoiced monthly and due within 15 days. There is no subscription, minimum, or long-term commitment.
You may cancel before work starts at no charge. After work starts, I may invoice the completed portion, never more than the accepted fee. Corrections and revisions within the agreed assignment are included and take priority, including one extra comp each time a revision comes back. Additional comps or materially new work are quoted before they begin. If I cannot correct an item expressly included in the scope, that order's fee is waived.
4. Responsibility and liability
Appraisal Partners is responsible for its drafting and data entry against the sources provided or collected for the assignment. The signing appraiser remains responsible for the inspection, independent review, final analysis and conclusions, certification, signature, delivery, and professional obligations to the client and regulator.
Appraisal Partners' total liability for an assignment is limited to the greater of three times its accepted fee or $1,500. Neither side is liable to the other for consequential, incidental, or punitive damages or lost profits.
5. Ending the relationship and disputes
Either side may end the relationship by email. These terms still govern work already accepted.
Texas law governs. We first try to resolve any disagreement directly. An unresolved dispute goes to binding arbitration in Collin County, Texas, with small claims court available where applicable. If one provision cannot be enforced, the rest remain effective.
These terms, the order's quoted rate, and the order's form with its READY record are the entire agreement for that order. Changes require written acceptance by both sides, including by email. A later version applies only to orders whose form links it, and does not change work already underway unless both sides agree.
